Megaman/Tron mashup design being sold limited time

Artist DJKopet, is selling various items of megaman depicted as a tron character. itmes are being sold for a limited time on riptapparel.com. amazing work if your interested in megaman or even tron its something dont wanna pass up

Things like teefury do this all the time. I dont think its illegal. Designs cool but not for me

It's a legal grey area, at least in the US.

Technically, the artist doesn't own the rights to the character, so they aren't allowed to make money off of the character without permission from the company. However, the art itself likely wouldn't be considered illegal, because it's an original derivative work, which would be classified under the fair use laws.

The company could sue and it would ultimately be up to the judge whether or not it's infringement of copyright or if it falls under the fair use laws. However, it would more than likely be classified as fair use because it's original artwork, and it would cost way more money for the company to hire lawyers than they would get from any profits the shirt made, even if the court ruled in the company's favor. Which is why you never really hear of companies suing artists for things like tee shirt designs. It's also free publicity for the company, so they generally don't care.

As an artist, I did a bit of research into these laws, because I've created and sold fanart of copyrighted characters.

Exactly. Here is something my step-brother did. It was requested of him to do so he sold it but he couldn't mass produce this and try to sell it in stores (if that makes sense). And yes he is made out of scrabble pieces :P
