This Five Year Old Kid Accidentally Got A 3DS Full Of Porn For Christmas

avt-small.png According to 9News, this Christmas, the Giles family found themselves horrified after their five year old son, Braydon Giles, found racy pictures on his refurbished 3DS. Presumably, the pictures came from previous owners who utilized the system's camera function. (...who the hell DOES that? For porn, I mean.)

The pictures were discovered when the kid asked his older brother with some help in deleting the pictures. There were nine in all.

Naturally, the father—Mark Giles—returned the 3DS. GameStop apologized for not catching the pictures before trying to sell the system, and then offered the family a new 3DS.

Despite being appreciative, the father doesn't feel that the new 3DS really makes up for what happened.

"You can't unsee this he's 5 years old maybe when he's 18 or 20 maybe he won't know anything about it but he's not going to forget about this tomorrow," Giles said.

As our own Chris Person put it: "You can't refurb a kid's brain."

...Wow. I don't even. First of all, Nintendo THEMSELVES have stated that the 3DS harm's children under 6's eyes, and as such is 6-7+. Great parenting. Second, he's frikkin FIVE. He'll likely forget it the next day. Third, how the hell is this even SUPPOSED to "mess up his brain"? Who the hell cares about seeing porn at any age? Ohnoes, I saw my mom's boobs when I was like 4, suddenly I'm a serial killer. Yeah right. I don't know why the US is so strict about this stuff. Even in M games, they'd much rather show Kratos splitting someone in half/gouging someone's eyes out than a full on naked chick. Yeah, I don't know how that works either.

Also, I like how they're whining over something like this, much less want to be compensated for, when these are some of the risks buying a device used.

Seriously, people's reaction to nudity is pathetic. I had a customer who was buying Mortal Kombat for her kid. I was explaining why it was rated M and Brutal Violence and Gore were ok, but Partial Nudity was the drawing line. She would rather her kid see some guy get cut in half with a hat than see Sindel's hair covering up her breasts.

Also I love how you can show a man's ass and it is OK, but if you show a woman's ass the rating of the movie/show goes up :blink:, we are screwed up society.

I'm not an american so I can't go to any GameStop. But if I was, I would stop buying there games and consoles (unless there are no other cheaper games and consoles) and I agree with what the parets said. Everyone here disliked this because "It's porn!!!!!!! Let's watch boobies!!!!" Well I can't understand this, porno should be something to banished from the earth like cigars, drugs, alchool, but that's not the point. Before anyone asks I'm 17 and at this age everyone thinks I watch porn. Well that's not true. I only know porno by name and by "friends" telling stuff about that. If I want porno, I want in 1st hand, which will never happen.

But I agrre whit the parents, okay is not going to remember in a few years. But that can lead problems, I mean psycologic problems seeing porno at 5 years old. Everyone is going to tell me many things after you read this. I have a 6 year old brother, and I care about what he sees, sometimes, I don't know how, he finds video of porno (not intencionally of course) and as soon as I discovered that I close Chrome or make him watch Sonic or PewDiePie video's (what he likes most). I think my parents don't care what he watches. But I care, who can tell me that seeing porno video today will not make my brother in a few years like that stupid teenagers that hang around, smoke drugs, drinks beer, smoke cigars and have girlfriends just to have sex with them?

If it has nudity (complete or partial) don't care I will not get that game, In January will be Mortal Kombat for free on PS+, but I'm thinking of not getting that game, not because the trophies, but because of my brother. The less he watches, the better it would be. Who can say my brother will be a lawyer, a police, a fireman, a president????

But surely he will not be that kind of people if he knows about those things.

A friend of my dad gave him a old X-BOX, what are the games? Oddworld Munch's Oddysee, Halo and Leisure Larry something, Tryed the Oddworld, loved it. Tryed Halo, liked it but not playing much, tryed Larry, worst game ever. When my brother would that game I would say something to not let him play that game. Well is fine now only with 3 years old and playing that game, he said he didn't liked it so it's good. But people should stop doing that kind of games, because who plays games are more likely kids in the age of my brothers, and what they do? That kind of games, it makes me sick just to think about.

Now I let you say your stupid comments, I don't really care. Oh and I'm not religious of any kind. So don't start with that too.

Have to say I agree with gamerm, what an overreaction. Yes, Gamestop are at fault for not clearing the system properly, but they apologised and replaced the DS, what more does the father want?

This society's attitude to sex and nudity is so backwards and wrong. Parents who don't bat an eyelid at kids playing/watching violent media but recoil in horror at the idea of partial nudity? The human body and its reproductive functions is the most natural thing in the world, so why act like its something dirty to be ashamed of. you know what leads to most teenage pregnancies and STDs? Lack of sexual education. Not to mention the growing numbers of teenagers who hate their own bodies. Also, nudity doesn't have to be sexual (I'm not saying it wasn't in this case) but how can a child understand sexuality when they are not yet old enough to feel sexual desires and the like, seeing a picture is hardly going to 'scar them'. I accidentally walked on things I shouldn't have seen as a child and it was never something I dwelled on, hasn't affected me in any way...

^ this too. Research has shown that children under 3 shouldn't even be watching TV as their eyes are not developed enough and it can be damaging. Games and 3D are likely far more damaging so that is something to consider in young children. Furthermore, whilst it should be stressed that there is no psychological evidence linking video game violence and violent crimes in adults, THERE IS evidence that young children are very impressionable and will emulate things they see in the media, the younger the child the more impressionable... Lastly, & I'm gonna sound totally old-fashioned here. As much as I love games, I think when I have kids I won't be buying them any consoles til their a bit older. I want them to enjoy other things, like playing outside, reading books, drawing with crayons etc. before they get totally sucked in to the gaming world.

Anyway rant over, sorry, I'm doing a degree in psychology so this kinda stuff gets me thinking :P

As much as I love games, I think when I have kids I won't be buying them any consoles til their a bit older. I want them to enjoy other things, like playing outside, reading books, drawing with crayons etc. before they get totally sucked in to the gaming world.

Well, I got a daughter, she is 5 years old and she plays on my ps3, and also I gave her a super nintendo, but I dont let her play a lot of time, usually she plays a little and then gets bored and moves to something else, so the problem isnt that you give a console to your kids, the problem is that you don give them limits, they can play videogames but not all day.

well that's great if you're supervising her and limiting her game use, of course I was not condemning games for kids completely, they just need to be regulated carefully :) it just seems too many parents these days use tv/games etc. as something to 'babysit' the kids all the time and don't encourage them in other hobbies.

I am not saying you don't have to be careful, but your logic is really flawed.

1. At that age kids are just developing their memory, which means that he probably won't remember what he saw.

2. By demonizing nudity all you are doing is tempting him to seek it out. Also you are making it so when he is finally old enough to start dating girls, he will have such a warped nature about it because you have taught him that the female body is evil.

3. What is funny about society is parents have no problem bringing their kids to a beach where they can see girls wearing very little but if you get rid of that little bit of fabric it becomes the biggest deal in the world. In fact how many times have we seen magazine ads displayed proudly in stores where a girl is covering herself with her fingers. Now if that girl moved her fingers away that magazine would have to be put behind the counter.

Nudity is somehow worse then violence? What is wrong with the world today? Nudity is natural, violence is not. Also, do you really think that lawyers, police, firemen, or even the president only got there because they never saw porn growing up. I call bullshit. I would hazard a guess that almost everyone has seen nudity/violence/drug use growing up, and yet we still have the lawyers, firemen, police, and a president. It would be better to introduce people to these temptations when they can be taught how to handle them. Say your brother becomes a lawyer, gets lots of money, and then is introduced to crack cocaine. He has never learned anything about it before and, so he gets hooked. How is that better? Take the chance to teach him the good and the bad in the world. Teach him to make good decisions, and then when he experiences these temptations later in life, he can use what you taught him.

I used to steal Dads Playboy magazines when I was 6. I don't think that it's warped my childhood. I was just curious and I wasn't scared for life, lol.

Everyone needs to relax about nudity. It's a great thing and everyone loves tits and ass!

im only going to say i completely against almost everything you said and there is nothing intelligent that i can say that has not already been said.

i think that this was a big overreaction by the parents first off they bought it used which means that anyone could have had it and obviously the person who had it before wanted to give the next owner a little added gift that was completely wasted on this 5 year old but all joking aside if the parents are upset with this then they should educate themselves when it comes to buying things like this and when buying anything used there is always the risk of things like this

Wrestling games would surely count as partial nudity too than or don't they considering what the female wrestlers wear so comparing that to Mortal Kombat shouldn't the "supposed" problem lie with the violence and even then?

Violence/Nudity in games or media causes no more problems than what you'd see out in the street so BrunoBomb I'm going to assume you don't go to the beach or pools due to partial or full nudity?

As for porn preventing any of the jobs listed only a very specific type would cancel any chances at landing one of those jobs, you know what that type is, here's a hint it is illegal...

BrunoBomb, I certainly respect that you are looking out and really care for your younger brother, but you really don't seem to have a clue what you're talking about. Seeing nudity at a young age won't mess someone up (I'm not talking about hardcore porn, that can potentially cause issues) and it certainly won't prevent them from getting good jobs. Hell, our last President was snorting coke while dodging the draft thanks to his daddy in high places, so if the public is okay with that I think they'd be fine if you've seen a boob or two. Keep looking after your brother though, that is a great quality and he'll appreciate that for the rest of his life.

And to the topic on hand, it sucks GameStop made a mistake but they tried to make it right and I hope the family doesn't try to sue and get millions of dollars. Your kid saw some titties, big deal, you shouldn't get money for that. An apology should be all that's warranted and they want above and beyond (in my opinion) when they offered a new 3DS.

Another year, another Nintendo handheld packed with pornography under the Christmas tree. Last year it was a five-year-old and a used 3DS. This year it's an eight-year-old and a supposedly brand-new 3DS. P

According to a report from WAVY10 News, Tom Mayhew purchased a "new" Nintendo 3DS for his eight-year-old son from a Walmart in Hampton, Virginia on December 23. P

On Christmas day, the son and some other children from Mayhew's extended family were playing with the new handheld, taking pictures of each other with the system's built-in camera. When they went to retrieve the photos, they discovered there were already some pictures in the system's memory — about a dozen pornographic images. P

"It was a shocker because we had family here, and there were a lot of kids here," Mayhew told WAVY. "The kids were the ones that discovered those pictures."P

Mayhew's first thought was the inclusion of the pictures might be a Nintendo error of some sort. Upon discovering the pictures carried an early December timestamp, however, he now believes the item was purchased and then returned to the Walmart, with the offending images still in memory. P

WAVY's 10 On Your Side consumer advocacy program contacted Walmart for comment, but has yet to hear back. Not sure what the retailer could do at this point. A new 3DS would be nice, but the psychological damage is already done.
