A case in whch the supreme court ruled that being a puplic figure basically made you fair game for satirical humor ie political comics or in roberts case a cimic of him in bed with his mother.She doesn't stand a chance. She did it once.... and not only did she "get away with it" but she also got something for her troubles -- E-Trade paid her off to go away. I can't fault someone for repeating behavior that got them rewarded because that's the sort of thing you expect from people. If E-Trade or the justice system or common sense had bitchslapped her back in the day, it would have sent the message that such behavior isn't going to get her anywhere. I draw parallels to good parenting. If your kid breaks curfew (or raids the cookie jar or wrecks the car or whatever) and you don't punish them for it, the message that gets internalized is that such behavior is acceptable. Either it's an ambulance chaser working on retainer hoping for Rockstar to quickly pay up and make the court filings go away (and so the lawyer can get 20-40% of the take) because said payoff is often cheaper for a corporation than fighting the issue out in court, or it's someone working pro bono in the hopes that the publicity and/or notoriety from the case will get them attention and said attention will draw them future clients. Also, never count out the ability of the American justice system to come up with a completely nonsensical result. Especially when a jury gets involved. Especially in California.
